Terms of Service

1. Agreement to Terms

By accessing or using the PokeScreener website (pokescreener.com) or the PokeScreener Card Scanner mobile application (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not access or use the Service.

2. Definitions

• "Service" refers to the PokeScreener website and mobile application.
• "User", "you", and "your" refer to the person accessing or using the Service.
• "We", "us", and "our" refer to PokeScreener, operated by Mertcan Dundar Esmergul, based in Amsterdam, the Netherlands.
• "Content" refers to all materials, features, data, and functionality made available through the Service.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

4. User Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or create derivative works of the Service.
• Use the Service for any unlawful, fraudulent, or abusive purpose.
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
• Transmit viruses, malware, or any malicious code through the Service.
• Scrape, crawl, or bulk-download Content except where explicitly permitted.
• Resell, sublicense, or transfer your account or access rights to another person.
• Use the Service in any way that could damage, disable, overburden, or impair its functionality.

5. Intellectual Property and Pokémon Disclaimer

5.1 Service Ownership

The Service, including all original content, features, functionality, software, design, and branding, is owned by PokeScreener and is protected by copyright, trademark, and other intellectual property laws.

• All trademarks, service marks, and trade names related to PokeScreener are proprietary to PokeScreener.
• Users may not copy, modify, or distribute any part of the Service without prior written consent.

5.2 Pokémon Intellectual Property Disclaimer

Pokémon, the Pokémon Trading Card Game (TCG), and all related media — including but not limited to card images, symbols, names, characters, and distinctive likenesses — are registered trademarks and copyrighted properties of The Pokémon Company International, Inc., Nintendo Co., Ltd., Game Freak, Inc., and Creatures Inc.

• PokeScreener is an independent application and is NOT affiliated with, sponsored by, or endorsed by The Pokémon Company International, Nintendo, Game Freak, Creatures Inc., or any of their subsidiaries or affiliates.
• The Service is designed as a companion tool for Pokémon TCG players and collectors, operating under fair use principles.
• All Pokémon-related content displayed in the Service is owned by its respective rights holders. We do not claim any ownership rights to Pokémon intellectual property.

5.3 Fair Use Statement

The Service is intended for personal, non-commercial use by TCG enthusiasts. Any Pokémon-related content accessible through the Service is displayed for informational, reference, and collection management purposes only.

5.4 Compliance and Removal

Users agree not to use the Service in any way that infringes upon the intellectual property rights of The Pokémon Company International or any other rights holders. We will respond promptly to legitimate takedown requests from rights holders.

5.5 User Responsibilities

Users agree to:

• Use Pokémon-related content solely for personal, non-commercial purposes.
• Not redistribute, sell, or commercially exploit any Pokémon-related content accessed through the Service.
• Respect all intellectual property rights related to Pokémon TCG.
• Report any potential intellectual property violations to contact@pokescreener.com.

6. Price Data Disclaimer

Card prices, portfolio values, and market trend information displayed in the Service are sourced from third-party providers and are provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of this data. The Service is not a financial or investment tool, and nothing in the Service should be construed as financial, investment, tax, or trading advice. You are solely responsible for any decisions you make based on information provided by the Service.

7. User Accounts

If you create an account, you:

• Are responsible for maintaining the confidentiality of your login credentials.
• Must provide accurate and complete information.
• Must promptly update any changes to your information.
• Are solely responsible for all activities that occur under your account.
• Must notify us immediately of any unauthorized access to your account.

8. Subscriptions and Payments

PokeScreener offers an optional paid subscription ("Pro") that unlocks additional features. Pro can be purchased through two channels, each governed by its own payment processor and billing rules:

8.1 Web Subscriptions (Stripe)

• Web subscriptions are processed by Stripe. By subscribing on the web, you agree to Stripe's terms and authorize recurring charges to your selected payment method.
• Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your Profile page; cancellation takes effect at the end of the current billing period.

8.2 iOS Subscriptions (Apple In-App Purchase)

• iOS subscriptions are billed through your Apple ID by Apple and are governed by Apple's Media Services Terms and Conditions.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in iOS Settings → [your name] → Subscriptions. Deleting the app does not cancel the subscription.
• Payment is charged to your Apple ID account at confirmation of purchase. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

8.3 General

• Prices may change; any change will be communicated before it takes effect and applies to the next renewal period.
• You are responsible for any applicable taxes.
• Refunds are handled according to the rules of the relevant payment processor (Stripe or Apple) and applicable consumer protection laws. We do not process refunds for purchases made through the App Store; those must be requested directly from Apple.
• Users in the European Union have statutory consumer rights, including the right of withdrawal, which remain unaffected by these Terms. By starting to use Pro features immediately after purchase, you expressly consent to performance of the service before the withdrawal period expires and acknowledge that you lose your right of withdrawal once the service has been fully performed.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that card identification, price data, or other information will be accurate or complete.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PokeScreener and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or for statutory consumer rights.

11. Indemnification

You agree to indemnify and hold harmless PokeScreener and its operator from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time.
• Update these Terms at any time, with notice given by updating the "Effective Date" above.
• Change features, pricing, or functionality.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms, suspected fraud or abuse, conduct we reasonably believe violates applicable law, or for any other reason we deem necessary to protect the Service or its users.

14. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions. Any disputes shall be submitted to the competent courts in Amsterdam, the Netherlands, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
